1. Who we are
CloseKin Play is provided by MyCloseKin LTD ("we", "us", "our"). By creating an account or continuing to use the service, you agree to these terms and are contracting with MyCloseKin LTD.
You must be an adult (18 or over) to create an account. Children use CloseKin Play together with a grown-up under that grown-up's account and supervision.
2. The service
CloseKin Play provides playful conversation cards and shared activities for grown-ups and children to enjoy together on one screen. The screen starts the conversation — you do the talking. We never record or store what you say to each other.
We grant you a limited, non-exclusive, non-transferable right to use the service for your family, within your selected plan. We do not guarantee that the service will be uninterrupted or error-free.
3. Free trial and Family Access
New families receive 14 calendar days of free play in the first realm (The Wild Wood). After the trial, continued access requires a Family Access subscription (£3.99 per month or £29.99 per year), which covers unlimited grown-ups and children in your family.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms: paddle.com/legal/checkout-buyer-terms. Subscriptions renew automatically until cancelled; you can cancel at any time and keep access until the end of the paid period.
4. Acceptable use
You must not misuse the service. This includes unlawful use, fraud or spam, infringing anyone's intellectual property, and interfering with the security or operation of the service (including introducing malware, probing vulnerabilities, or scraping the service).
You must not reverse engineer, resell, redistribute, or circumvent technical limits of the service. You are responsible for keeping your account credentials confidential and for all activity under your account, and for providing accurate information.
5. Intellectual property
We retain all ownership of the service and its intellectual property, including the software, card content, artwork, documentation, and branding. Your family's conversations remain yours; we do not claim any rights over what you say to each other.
6. Warranties and liability
The service is provided "as is". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.
7. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, your account data will be deleted or anonymised in line with our Privacy Notice.
8. General
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory consumer law in your country gives you other rights. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control.
